The question of evidence and the scene of justice in India
We know about the commission of crimes and other wrongs but cannot prove it.We experience the problem but cannot help to solve it.We are bound to tolerate or even get involved into the foul plays taking place in our society.Who do not know that 99% of our public officials and politicians are corrupt either in one way or the other and nothing is going to happen against them due to the want of evidence?The rules of evidence were created by the British for their benefit in such a way that it complicated the legal disputes giving advantage to the mighty and well connected people and we still continue with those rules to give benefit to the British among ourselves.Can we not easily feel the quantum of corruption when we see an ordinary citizen getting possession of grand houses,luxury cars and changed lifestyle after getting selected into the government services or in political positions?
Even if one is a witness of the commission of an offence he/she cannot be sure to get the culprit punished because there will be created so many doubts in the evidence for the benefit of the offender due to the inadequacy of our rules.Is there really a lack of evidence for the wrongs committed around us or there is a lack of willingness to accept the evidences as they exist ?Why not we simplify our evidence rules and accept the fact that if there is an offence there is definitely the criminal and he must in all circumstances be brought to justice and be punished.How come there be a crime without a criminal?And if we accept that there is a criminal if there is a crime then we are bound to punish him/her.But actually it is not like that.We in fact accept that there is a crime but either we do not accept that there is necessarily the criminal or if there is a criminal we do not accept our responsibility to bring him to justice. This is the reason that we often hear about scams and scandals, corruption cases, murders and robberies and so on, but we also hear that nothing ultimately happened and the wrongdoer is freely roaming around without any feeling of guilt.
