Now that gays and lesbians can legally marry in California, a retired Presbyterian Church (U.S.A.) minister is again challenging her denomination’s position on same-sex marriage by officiating the wedding of two women.

The Rev. Jane Spahr plans to preside over the ceremony Friday afternoon in front of the Marin County courthouse in San Rafael. One of the brides, a lawyer who represented Spahr when she faced misconduct charges for performing weddings in 2004 and 2005, picked the location over a local Presbyterian church that had offered to host the service.

Two weeks before the California Supreme Court legalized same-sex marriage, the highest court of the Presbyterian Church concluded that Spahr did not violate the part of the church’s constitution that defines marriage as a covenant between a man and a woman because the ceremonies she performed were not marriages.

Spahr says a similarly technical ruling won’t be possible this time, because she intends to pronounce the women she is marrying Friday under both the authority granted her by the state and her standing as a minister.

She says she hopes to send a message to church leaders gathering in San Jose for a weeklong legislative meeting, at which changes to the denomination’s positions on marriage and the ordination of gay clergy are scheduled to be discussed.
