Mukasey: Congress should set rules for detainees

Attorney General Michael Mukasey wants Congress to figure out how to give Guantanamo Bay terror detainees their day in U.S. civilian courts.

Mukasey says last month’s Supreme Court ruling that gave foreign suspects the right to challenge their detention leaves significant questions unanswered. He says lawmakers _ and not federal district judges _ should decide the rules governing the detainees’ hearings.

Mukasey was to make his request in a Monday morning speech, parts of which were obtained by The Associated Press.

About 200 detainee cases are being reviewed in U.S. District Court in Washington, where judges have said they want to set rules for the hearings by year’s end.

It’s unclear at best whether Congress could act by then.
