Whether it is a petty matter of family dispute, street encroachment, vocational training to sex workers or serious issues concerning women safety, black money in foreign banks, high scale corruption, sensational scams, supreme court is there as sentinel to guard against infringement of citizens’ rights and misuse of power by the wily politicians. Murdered Jesica wouldn’t have got justice but for public outcry and Supreme Court’s interventions.

“No government wants a strong judiciary” said an exasperated Supreme Court bench recently commenting on meager budgetary allocation to judiciary that is less than 1 percent. In fact apex court‘s intervention is strongly disliked by the politicians for obvious reasons. Prime minister’s indirect warning to the judiciary to remain within its limits is linked to the discomfort for putting the government in the dock in cases like 2 G scam, black money stashed in foreign banks and controversial appointment of P J Thomas as the CVC. In the case of 2G Spectrum scam the Supreme Court has asked the prime minister to file an affidavit on why he was silent on the 2 G scam. It is first time in the history of the country; the Supreme Court had to take name of the prime minister and asked him why he was silent on 2G scam. Distressed by the Court’s relentless pursuance of scam cases, the peeved prime minister said that ‘Caesar’s wife must be above suspicion’. He used this idiom to emphasize that he has nothing to hide and that he should be above suspicion. Not convinced by government’s reply in the 2G scam case, the Supreme Court had to slam Kapil Sibal the new telecom minister for his efforts to white wash the scandal and misleading the public on this mega corruption issue.
Altercation between the government and Supreme Court continuers perpetually, the politicians wants full freedom to act in the manner they desire without any probe into their wrong doings and the Supreme Court acts as a guardian of the constitution and the highest court of appeal in the country. Because of divergent interests the two do not trust each other.
Miffed by the Supreme Court’s regular prodding, the prime minister has on number of occasions asked the Court to stay away from procedural matters.Every year thousands of tons of food grains are destroyed by rotting in the open due to apathy of the government. But the government is still not ready to do something about it. Instead of taking some action, the prime minister criticized Supreme Court for ordering the government to distribute surplus food grains to poor people free of cost.
The foundation of democracy is raised on the pillar of strong judicial system of the country. Absence of strong judiciary will provide more opportunities to the criminals to exploit the masses. In a recent hearing of Amar Singh’s phone tapping case Supreme Court has expressed fears with regard to privacy and freedom in the country for its citizens. A bench comprising of Justice G S Singhvi and Justice A K Ganguly said “No person living in India is safe. Will this nation be the target for years? There are master forgers and experts in fabrication of records”. If the apex court has expressed anguish over the state of affairs in the country, God save the common man. Can you Imagine your life in the absence of Supreme Court which at times appears to have run the country.
